The House of Representatives, controlled by Democrats and led by Nancy Pelosi is asking a court to reject Texas Congressman Louie Gohmert’s recent lawsuit against Vice President Pence. This lawsuit seeks to establish that Vice President Mike Pence has the power to reject electoral college votes in Congress when they are are presented on Wednesday for certification. Constitutional expert, Rick Green says the Court’s ruling on the lawsuit could have significant impact on whether things go in Trump or Biden’s favor on that day. In this episode we lay out in as simple terms as possible what we can expect to happen when two opposing slates of electors from the same state—one slate for Trump; the other for Biden—arrive at Congress for certification of election results. What does the “Electoral Count Act of 1887” that everyone’s talking about say should happen and why do the Democrats appear to be pushing for this Act to be followed rather than what the Constitution says should happen?
